This paper examines some of the possible legal implications of the production, marketing and use of expert systems. The relevance of a legally useful definition of expert systems, comprising systems designed for use both by laymen and professionals, is related to the distinctions inherent in the legal doctrine underlying provision of goods and provision of services. The liability of the sellers and users of, and contributors to, expert systems are examined in terms of professional malpractice as well as product liability. (...) The forefront of neurological care—and the neuroethical issues and methods focal to such practice—wasn’t what I initially intended to do professionally, but I think that therein is a good lesson for young people’s career aspirations. Simply put, one doesn’t always know where they’ll end up at the beginning of the journey, and as Kierkegaard said, life is lived forward, but is understood backwards (Kierkegaard 1843).In the nineties and the early 2000s, I was trying to help improve the quality of care of people at the end of life, and I wrote a book, entitled The Palliative Ethic of Care: Clinical Wisdom at Life’s End (Fins 2006), in which I addressed notions of phronesis—practical wisdom—in integrating theory and practice toward improving how people die. I became interested in the Quinlan case (Quinlan 1976), and the right to die, and around the same time, I ran into a colleague of mine at Cornell: Dr. Nicholas D. Schiff. Dr. Schiff is a neurologist, who was a protégé of Fred Plum, who was the originator of the concept of the vegetative state with Bryan Jennett, back in 1972. Fred was both of our teachers here at Cornell. Niko (Dr. Schiff) was interested in patients with disorders of consciousness, and was beginning to envision doing work—that ultimately, we did—using deep brain stimulation (DBS) to try to treat patients in the minimally conscious state, a category that was subsequently codified in 2002.I realized that a whole population of people—with these disorders of consciousness—had been somewhat marginalized, and their neglect essentially devolves back to the considerations of the right to die. The right to die was established in the Quinlan case because Judge Hughes—the presiding chief judge of the New Jersey Supreme Court—talked about Ms. Quinlan’s loss of a cognitive, sapient state as being the moral warrant for her right to die, given the fact that it was viewed as a futile situation. ABSTRACTPerhaps no American state has seen more legal activity on assisting suicide than Michigan, but despite legislation, a study Commission, several legal cases and a state Supreme Court ruling, the state seems much further from a humane resolution of the question than when the activities of Dr. Jack Kevorkian began in June of 1990. This note summarizes major legal events over a twelve‐month period , which included jury acquittal of Dr. Kevorkian, the inconclusive report of the Michigan Commission on Death (...) and Dying, the failure of the state legislature to enact legislation to replace the expired absolute but temporary prohibition, and the decision of the Michigan Supreme Court in Mich v. Kevorkian declaring assisting suicide a common law felony and ruling that in certain circumstances a person assisting suicide can be prosecuted for murder. The Commission's model decriminalization proposal and the bills subsequently introduced in the legislature , as well as the decision of the Supreme Court, are discussed. Certain puzzling features of the latter, especially with regard to the kind of causation that can turn helping another commit suicide into murder, are noted. (shrink)

During this time, history has moved faster than ever before. To the dramatic upheavals in society, politics, science, and culture correspond also profound breakthroughs in philosophy and theology. Can a text from back then still be current even today? When I reread this lecture, which in the meantime had been published once again by my circle of students in a volume with texts written over the course of four decades,1 only then did I become fully aware of how much the questions posed back then have remained until today guidelines for my thinking. These questions recur in my Introduction to Christianity (1968), but especially in the lecture I gave at the Sorbonne in Paris entitled "Christianity—the True Religion?"2 Naturally, the lecture was modified and reshaped by each of the new contexts.What remains today, and what will be tomorrow a central task of theological thinking, is in any case the twofold question around which the considerations of the Bonn lecture revolved. There is first the general question of the relationship between faith and reason: what kind of rationality is appropriate for the Christian faith? How does faith fit into the whole of our existence? Is faith reconcilable with the fundamental insights that modern reason has acquired? Does the faith respond to reasonable questions and is its "reason" communicable? This fundamental problem inside our faith and theology becomes concrete as a question: Was the consummate connection in the nascent Church between Greek thought and biblical faith lawful, so that this relation belongs to "the essence of Christianity," or was it a "disastrous misunderstanding" from which we must finally liberate ourselves? In late May 1984, Irish citizens were perturbed to hear that a thirty-one year old man died while participating, as a paid volunteer, in a clinical drug trial at the Institute of Clinical Pharmacology in Dublin. At the inquest, held in September 1984, the State Pathologist, Dr John Harbison, affirmed that the cause of death was the reaction of the trial drug Eproxindine 4/0091 with a major tranquillizer which had been given less than fifteen hours earlier as part of regular (...) treatment for a psychiatric disorder. Transplantation continues to push the frontiers of medicine into domains that summon forth troublesome ethical questions. Looming on the frontier today is human facial transplantation. We develop criteria that, we maintain, must be satisfied in order to ethically undertake this as-yet-untried transplant procedure. We draw on the criteria advanced by Dr. Francis Moore in the late 1980s for introducing innovative procedures in transplant surgery. In addition to these we also insist that human face transplantation must meet all the ethical requirements (...) usually applied to health care research. We summarize the achievements of transplant surgery to date, focusing in particular on the safety and efficacy of immunosuppressive medications. We also emphasize the importance of risk/benefit assessments that take into account the physical, aesthetic, psychological, and social dimensions of facial disfiguration, reconstruction, and transplantation. Dr. Hittinger's book causes us to remember how genuinely delicate and refined is the balance between reason and faith in St. Thomas' view of human knowledge and its relationship to reality. This enabled St. Thomas to develop with discernment his notion of (...) the natural law, because St. Thomas understood that an act of genuine intellection distinguished in order to unite, not separate. Therefore, there was an intrinsic unity to truth and a unity to philosophical experience which reflected reality-something which has gotten lost in the contemporary morass of interminable dialectics. Have the contemporary attempts to retrieve a notion of the natural law succeeded in maintaining this balance? If such attempts have not succeeded in maintaining the requisite balance, what are the consequences of the loss of this balance for the success of their endeavor? When in the history of philosophical experience this balance cannot be maintained, one is forced to move in one of two directions. The first is towards a kind of fideism in which the fundamental questions raised by reason are only resolvable by the faith; thus philosophy is absorbed into theology. The second is towards the claim that reason can answer all that is answerable (which may be very limited) and thus faith becomes subordinate to reason. The latter either leads to rationalism or a variety of positivism. For Rittinger what appears to be a contemporary attempt to retrieve natural law moral philosophy has proven itself unable to avoid a fideistic solution to moral philosophy; for faith in the end resolves all the fundamental issues raised in regard to moral philosophy. The beginning of the discussion of moral philosophy and man as the author of his actions was very carefully placed in the writings of St. Thomas. It is only after St. Thomas had established certain fundamental truths and principles in natural theology and the philosophy of human nature that he begins to discuss moral philosophy. St. Thomas first established the existence of a personal God, who is both the efficient and final cause of all finite being. God's being is also discovered to be identical to truth, goodness, and beauty. God is recognized as that which all men seek even though only the beatific vision will present this to the intellect and will with an all-consuming necessity. "Beings" are ordered in two ways, as parts of totality, and as things to an end. The ordering of things to an end is the most important, since the final cause is the cause of all the other causes. Also it is only after a great deal is known about human goods, and human nature, and the ordination of human goods that St. Thomas is ready to begin a discussion of the first principle that states the good is to be pursued or the good is to be done. St. Thomas has also established, through reason, that man by nature desires and should desire in justice to give God his due. There· fore religion properly understood is natural to man. The above pro· vided St. Thomas with the knowledge prerequisite for the development of a natural law moral philosophy. If one perceives that we are at a juncture in the history of philosophy where one no longer can develop or defend the kind of knowledge that is a prerequisite to the successful development of a natural law ethics, then this must he faced with all its consequences. Is a natural law ethics still viable? This is true even if one believes that any attempt to establish such knowledge would drag the ethician into an in· terminable debate in regard to the is-ought dilemma announced by Hume or the positivist rejection of metaphysics and the philosophy of nature. POPKIN ONE OF HUME'S MOST FAMOUS CRITICS, the great scientist Joseph Priestley (1733-1804), is scarcely mentioned or studied in the Hume literature.' Perhaps because of the course philosophy followed after Hume, the Scottish Common Sense critics and the German ones connected with Kant are given almost all of the attention. In this paper 1 shall try to correct (...) this oversight, and examine the background of Priestley's critique of Hume, both in terms of Priestley's scientific and religious views and in terms of Hume's influence at the time. I shall then evaluate the merits of Priestley's critique and attempt to determine whether it deserves further study or should be returned to the obscurity it has been in for almost two centuries. 2 Joseph Priestley was a nonconforming minister whose progressively radical views caused him to lose various posts. Eventually he became a millenarian, convinced that crucial signs of the end of the world were at hand: the events of the French Revolution; the purported discovery of the Lost Tribes in Afghanistan by Sir William Jones; plans or hopes for the Jews to return to Palestine and join forces with the Christians. After years of religious wanderings Priestley ended up a millenarian Unitarian, much in the tradition of Sir Isaac Newton, whose religious writing he used extensively, and of Newton's successor, William Whiston? Priestley taught science in various schools and was immensely influenced by David Hartley's Observations on Man. He found in Hartley's theory of association of ideas a naturalistic way of explaining human mental life. And in Hartley's millenarian views he located the sort of theology he was seeking. Gleeson, Damian John In 1924, after a hiatus of a decade, the Australasian Catholic Record was re-established under the driving force of Monsignor John Joseph Nevin, the then vice-president of St Patrick's College, Manly. Mgr Nevin was ACR's principal editor up until 1937 and with the exception of a trip to Ireland and Europe in 1927, he contributed articles and answered questions on topics ranging across canon law, marriage, and moral theology in virtually every quarterly issue of ACR for (...) more than two decades. At Manly, he educated thousands of seminarians for dioceses across New South Wales and beyond, and was the college's president from 1929 to 1942. As such, Mgr Nevin was probably the most formidable Catholic clerical academic in New South Wales in the interwar period, yet we know little of this prodigious writer and intellectual who was a key adviser, not just to the Sydney hierarchy, but to a wide range of bishops. Apart from Dr Kevin Walsh's splendid history of St Patrick's College, Manly, church historians have not sought to consider the significant career of Mgr Nevin and his influence on several generations of clergy and bishops. Hume'sDialogues Concerning Natural Religion are still much with us. What appears to be the definitive edition was published by Professor Norman Kemp Smith in 1935 with a learned introduction which, among other things, assembled a mass of evidence pointing to the conclusion that Philo is to be identified with Hume himself, and that Hume in the Dialogues is deliberately trying to undermine the religious hypothesis. Though these conclusions have been widely accepted, Dr. B. M. Laing, in the April issue of (...) Philosophy, strenuously attacked them in an ingenious argument based in part on his already published thesis that Hume's fundamental philosophy is not really the scepticism so long assigned him. Dr. Laing takes the opportunity in passing to indicate his sympathy with the recent position of a distinguished British poet that Voltaire, also, has been traditionally abused in the assumption that on the question of religion he wrote with his tongue in his cheek. The present examination is not designed to inquire into this new mode of making the wicked pious; nor to push the question back from the Dialogues to Hume's basic philosophy; nor to press the writer's conviction [“The Enigma of Hume,” Mind, XLV pp. 334–349] that not only is Philo to be identified as Hume, but in addition, Cleanthes as Joseph Butler, and Demea as Samuel Clarke. DR JOSEPH BOBIK’S article The First Part of the Third Way is a notable contribution to the literature on the subject. Anybody who has wrestled with the text itself—a text as profound and disconcerting as anything St Thomas has written—will be grateful for the many fine elucidations the article provides, and will be grateful especially for the fact that he has kept to the text itself as given in Summa Theologiae I, q 2, a 3 and has not read (...) into it some argument of his own. This method is particularly helpful and fruitful when there is question of pointing to a flaw in the argument. Against Kant and against most critics of the argument no defence is possible, for no real effort has been made to understand the argument in its own terms, within its own ‘thought-world’—one can of course insist that the attack is misdirected, but this kind of non-discussion scarcely serves the common pursuit of truth and will never enlarge anybody’s horizons. Dr Bobik, on the other hand, is able to point to the exact proposition in the text which he finds faulty and he is in a position to situate this proposition in the general context of Thomist metaphysics. In such circumstances there is everything to be gained by a further examination of the proposition and its context. (shrink)

This essay focuses on the history of psychometry, the science of soul measuring. For its founder, Dr Joseph Rodes Buchanan, the soul was simultaneously an object for anthropological research and a measuring instrument capable of revealing human character, interpreting natural history, and demonstrating the reality of an immortal soul. Psychometry taught that human souls, especially those of women, were capable of acting as instruments because they could feel the mysterious energies that people and objects radiated. Although orthodox male scientists (...) rejected the visions of sensitive women as the antithesis of reliable data, psychometric researchers believed that the feelings of women were both the instruments and information that made their science possible. Psychometry promised to revolutionize science by insisting that sympathy and subjectivity, not detachment and objectivity, ought to undergird research. Yet as male experimenters worked to prove psychometry’s effectiveness, they almost invariably cast themselves as detached observers accurately recording the data provided by their female instruments. Thus, despite pushing for scientific reform, the methods and discourse of male psychometric experimenters eroded their field’s core arguments about connectedness and subjectivity and, instead, reinforced the notion that detachment and objectivity were essential to legitimate science. Challenges to objectivity could prove just how thoroughly it dominated scientific discourse and practice. Still, some psychometers, particularly women who practiced at home, were untroubled by the fact that their research was predicated on subjective feelings, and psychometry remained a viable pursuit among spiritualists even as it faded from the realm of science. Psychometry emerged and, ultimately, fractured amid tensions between widespread enthusiasm for sciences that emphasized spiritual connectedness and the mounting pressure to legitimize scientific knowledge through the language and practices of objectivity.
